1. How often is the Guide updated?

5. My company does't make outbound calls; is the Guide relevant for us?

Yes. Many requirements apply to companies that conduct sales during inbound calls (registration, purchase disclosures, call recording, etc.).

6. My company is exempt from the DNC laws, we do not make sales calls.
– Do we still need the guide?

Since no goods/services/solutions are solicited to consumers, most of the telemarketing laws do not apply. Here are portions of the Guide that do apply to non-solicitation calls:
    • State prerecorded message requirements.
    • The TCPA's restrictions on using an autodialer (including predictive dialer) to call cell phones
    • Call monitoring/recording laws
    • Federal Truth in caller ID Act

7. Can I use the Guide as a substitute for legal advice?

No. Although the Guide is accurate and up to date, it should be used for informational purposes only. Please contact a lawyer to obtain legal advice.

8. What if I have questions related to the use of the Guide or its content?

Subscribers can submit questions to the Guide Administrator and/or Author through the online Guide. Questions will be answered as quickly as possible.
